'Prosecution Failed To Establish Guilt Beyond a Reasonable Doubt', Says Jammu and Kashmir High Court, Upholds Man's Acquittal in His Wife's Suicide Abetment Case

The bench of Justice MA Chowdhary said that even after the second marriage, the deceased was living with the accused and the second wife for the last 12 years. The judge also noted that there was no complaint lodged in those long years with regard to any torture by the respondent-accused.

The Jammu and Kashmir High Court recently said that in the absence of any substantial and credible evidence or any prior complaints, FIRs, or consistent testimony of cruelty over the 30-year marriage, it cannot be proved that the accused has abetted or instigated the commission of suicide of his deceased wife. The high court observed while dealing with an appeal filed by the state against the judgment acquitting the accused of the charges under section 306 RPC. It was argued before the Jammu and Kashmir High Court that the accused's cruelty, especially after marrying a second time, led to the deceased's suicide. However, the bench of Justice MA Chowdhary said that even after the second marriage, the deceased was living with the accused and the second wife for the last 12 years. The judge also noted that there was no complaint lodged in those long years with regard to any torture by the respondent-accused. After hearing both sides, the court upheld the trial court's acquittal of the accused and concluded that there was no error in the reasoning of the trial court and that the prosecution failed to establish guilt beyond a reasonable doubt.슬롯 머신 사이트 추천슬롯사이트˜She Has No Objection to the Petition for Quashing the FIR슬롯사이트: Jammu and Kashmir High Court Grants Bail To Rape Accused After Complainant Admits She Is His Wife.
